Drew Capuder spoke on wrongful discharge doctrine at the 2022 WVELA annual conference

On October 14, 2022, Mr. Capuder spoke and presented an article on “Update on Harless and Other Whistleblower Law” at the Annual Conference of the West Virginia Employment Lawyers Association at Lakeview Resort in Morgantown, West Virginia. His article and presentation focused on the wrongful discharge doctrine in West Virginia where the employer’s action allegedly violates a substantial public policy. The doctrine originated in Harless v. First National Bank of Fairmont, 162 W. Va. 116, 124, 246 S.E.2d 270, 275 (1978). He also focused on several other whistle-blower theories, such as the West Virginia Patient Safety Act, the West Virginia Public Employees Whistle-Blower Law, the Sarbanes–Oxley Act of 2002, and the Dodd–Frank Wall Street Reform and Consumer Protection Act of 2010.
